{"id":4120,"date":"2024-11-29T15:05:48","date_gmt":"2024-11-29T15:05:48","guid":{"rendered":"https:\/\/alcideproject.eu\/can-the-european-defence-community-edc-be-expanded-to-other-member-states\/"},"modified":"2024-12-16T15:53:17","modified_gmt":"2024-12-16T15:53:17","slug":"can-the-european-defence-community-edc-be-expanded-to-other-member-states","status":"publish","type":"post","link":"https:\/\/alcideproject.eu\/it\/can-the-european-defence-community-edc-be-expanded-to-other-member-states\/","title":{"rendered":"Pu\u00f2 la Comunit\u00e0 Europea di Difesa essere ampliata ad altri Stati membri?"},"content":{"rendered":"<p><b><i>Dr. Niels Kirst<\/i><\/b><i><span style=\"font-weight: 400;\"> (Assistente Professore di Diritto Europeo presso la Dublin City University, e Deputy Director del DCU Brexit Institute)<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">La Comunit\u00e0 Europea di Difesa (CED), proposta nei primi anni \u201950, rappresenta un momento cruciale nella storia dell\u2019integrazione europea e della sicurezza collettiva. Essa mira a stabilire un\u2019organizzazione di difesa sovranazionale, con l\u2019integrazione delle forze armate di sei stati membri: Francia, Germania, Italia e i paesi del Benelux. Considerando le crescenti sfide di sicurezza per l\u2019Europa a causa dell\u2019illegale invasione russa dell\u2019Ucraina e la seconda presidenza di Trump negli Stati Uniti, \u00e8 interessante chiedersi se la CED sarebbe aperta all\u2019adesione di nuovi Stati membri.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Da un punto di vista legale, il Trattato della CED consente esplicitamente l\u2019adesione di altri Paesi europei oltre ai sei membri fondatori. L\u2019articolo 129 della CED prevede che membri aggiuntivi possano unirsi alla comunit\u00e0, previa opinione del Commissariato e approvazione unanime del Consiglio. Secondo l\u2019articolo 19 della CED, il Commissariato \u00e8 un consiglio di esperti indipendenti nominati dagli Stati membri firmatari. L\u2019articolo 39 della CED prevede che il Consiglio sia l\u2019organo decisionale composto dai rappresentanti degli Stati membri firmatari, simile al Consiglio dell\u2019UE. La clausola di adesione riflette dunque la comprensione che le sfide di sicurezza europea non sono limitate ai membri fondatori, e che l\u2019espansione della CED possa rafforzare la difesa collettiva. Il Trattato richiede agli Stati che aderiscono di allinearsi con gli obiettivi di difesa condivisa della CED, sottolineando la capacit\u00e0 del Trattato di adattarsi ai cambiamenti geopolitici e alle esigenze evolutive della sicurezza europea.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Traendo ispirazione dall\u2019attuale funzionamento dell\u2019allargamento nei trattati UE, \u00e8 possibile immaginare la procedura di adesione alla CED. Proceduralmente, il primo passo consiste nel presentare una domanda di adesione al Consiglio della CED (\u201cOgni Stato europeo pu\u00f2 chiedere di aderire al presente Trattato.\u201d). Questo di solito avviene tramite una lettera di richiesta formale. Il primo paragrafo dell\u2019articolo 129 della CED stabilisce anche la prima condizione per l\u2019adesione, poich\u00e9 parla di \u201cStato europeo\u201d. Simile all\u2019articolo 49 del TUE, ci\u00f2 indica che solo gli Stati geograficamente situati in Europa possono aderire alla CED. Successivamente, l\u2019accordo unanime da parte degli Stati membri attuali \u00e8 una <\/span><i><span style=\"font-weight: 400;\">conditio sine qua non<\/span><\/i><span style=\"font-weight: 400;\"> per l\u2019adesione di un nuovo membro (\u201cIl Consiglio, dopo aver ottenuto l\u2019opinione del Commissariato, agir\u00e0 con voto unanime e determiner\u00e0 anche le condizioni di adesione con voto unanime.\u201d). Gli organi principali coinvolti sarebbero il Commissariato della CED (un consiglio di esperti indipendenti con 9 membri nominati), che emette un parere non vincolante, e il Consiglio (composto dai 6 rappresentanti dei membri fondatori), che approva la richiesta di adesione con voto unanime. L\u2019adesione \u00e8 possibile solo se tutti e sei i membri fondatori concordano all\u2019unanimit\u00e0.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In seguito, il Consiglio della CED stabilisce anche le \u201ccondizioni di adesione\u201d. Ci\u00f2 significa che un trattato di adesione dovrebbe essere redatto, simile al trattato di adesione nell\u2019ambito della procedura di allargamento dell\u2019attuale UE. Naturalmente, la CED deve essere pronta ad integrare le capacit\u00e0 operative di nuovo membro con quelle del patto di difesa. In questo senso, il trattato di adesione garantirebbe che l\u2019integrazione tra i membri vecchi e nuovi avvenga in modo fluido e ottimizzato. Come passaggio finale, l\u2019allargamento ad un nuovo membro potrebbe anche richiedere la ratifica del trattato di adesione e del Trattato della CED da parte del Paese accedente, in conformit\u00e0 con I suoi requisiti costituzionali nazionali. Ci\u00f2 potrebbe significare una ratifica da parte di entrambe le camere del parlamento. Infine, il trattato di adesione firmato dovrebbe essere inviato al \u201cGoverno che agisce come depositario del Trattato\u201d, che sarebbe il governo francese nel caso della CED (vedi articolo 130 del Trattato della CED). Con ci\u00f2, l\u2019adesione di un nuovo membro diventerebbe effettiva (\u201cL\u2019adesione diventa effettiva nel giorno in cui lo strumento di adesione viene ricevuto dal Governo che agisce come depositario del Trattato\u201d).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cosa rende speciale la CED? Un evidente valore aggiunto \u00e8 che i membri fondatori della CED potrebbero stabilire soglie di adesione \u201celevate\u201d, applicando criteri simili a quelli dell\u2019attuale politica di allargamento dell\u2019UE, come il rispetto dello stato di diritto e dei diritti fondamentali secondo i Criteri di Copenaghen. Ci\u00f2 permetterebbe anche l\u2019esclusione di Stati membri dell\u2019UE, come l\u2019Ungheria, che non rispettano lo stato di diritto e che si sono rivelati un \u201ccavallo di Troia\u201d all\u2019interno dell\u2019UE. Vantaggiosamente, l\u2019adesione alla CED sarebbe aperta a Paesi non membri dell\u2019UE che rispettano i valori dell\u2019UE e sono interessati all\u2019integrazione della difesa, come il Regno Unito e la Norvegia. In generale, l\u2019apertura del Trattato della CED ad ipotesi di allargamento suggerisce che esso sia progettato per accogliere un crescente numero di membri. La CED, quindi, si allinea con le discussioni in corso per una pi\u00f9 ampia architettura di sicurezza europea, tenuto conto delle crescenti tensioni geopolitiche dopo l\u2019illegale invasione russa dell\u2019Ucraina e la rielezione di Trump negli Stati Uniti.
